What is happening: Port drivers under the employment of California Cartage Express have filed complaints, claiming they are underpaid by at least one hour a day, every day.
Why is this happening: Drivers claim they are misclassified as independent contractors. Therefore they are not compensated for daily inspections, cleaning, repairing, or sick leave.
Claim: The drivers filed the claim with the Office of Wage Standards. They are also demanding an investigation by the City of Los Angeles.
Past issues: California Cartage have already been sued by the City of Los Angeles, ordered to pay $3.5 million in back wages, and featured in a USA Today expose about misclassification.
What did Councilman Joe Buscaino say at the time of these past incidents: “Trucking and warehouse companies cut costs by misclassifying employees and independent contractors in order to avoid paying the wages and benefits required by federal, state and city law, and by cutting corners when it comes to worker safety.”
